Accommodation Terms and Conditions

Article 1 (Scope of Application)

  1. These Terms and Conditions shall apply to accommodation contracts and any related agreements concluded between Kyomachiya no Yado Co., Ltd. (hereinafter referred to as “the Company”) and guests (hereinafter referred to as “the Guest”).

  2. In cases where the Company agrees to special provisions within the scope permitted by laws and regulations and public order, such special provisions shall prevail over these Terms and Conditions.

  3. These Terms and Conditions shall also apply to accommodation reservations made through websites, online travel agencies, or travel companies other than the Company’s official website.


Article 2 (Application for Accommodation)

  1. A Guest who intends to apply for an accommodation contract at facilities operated by the Company (hereinafter referred to as “Machiya”) shall provide the Company in advance with the following information:
    (1) Name of the Guest
    (2) Name of the Machiya to be stayed at
    (3) Contact details reachable on the day of stay
    (4) Agreement to the accommodation fee and payment conditions
    (5) Number of guests
    (6) Any other information deemed necessary by the Company

  2. If a Guest requests an extension of stay beyond the originally reserved accommodation period during the stay, such request shall be treated as a new application for an accommodation contract at the time the request is made.


Article 3 (Conclusion of Accommodation Contract)

  1. An accommodation contract shall be deemed concluded when the Company accepts the reservation application made by the Guest.

  2. Upon conclusion of the accommodation contract, the Guest shall pay the full accommodation fee by the date specified by the Company.

  3. If payment is not made by the specified date and no agreement regarding payment extension has been reached between the Company and the Guest, the Company may cancel the accommodation contract.

  4. If only part of the accommodation fee has been paid, the Guest shall obtain prior approval from the Company regarding the timing and method of payment of the remaining balance. If such approval is not obtained, the accommodation contract shall not be deemed concluded, the reservation shall be cancelled by the Company, and any amount already received shall be refunded after deducting bank transfer fees borne by the Guest.

  5. The accommodation fee presented at the time of reservation includes consumption tax and service charges.


Article 4 (Refusal to Conclude Accommodation Contract)

The Company may refuse to conclude an accommodation contract only in the following cases:

  1. When the application does not comply with these Terms and Conditions.

  2. When all guest rooms are fully booked.

  3. When the Guest is deemed likely to engage in acts that violate laws, public order, or good morals in connection with the accommodation, or has engaged in such acts.

  4. When the Guest is recognized as a member of an organized crime group, a related party thereof, or other antisocial forces.

  5. When the Guest is deemed likely to make violent demands, threats, or other unreasonable requests exceeding socially acceptable limits toward employees of the Company.

  6. When accommodation cannot be provided due to natural disasters, facility failures, or other unavoidable circumstances.

  7. When the Guest fails to cooperate, within a reasonable scope, with requests for guest registration or identity verification required under applicable laws and regulations.


Article 5 (Right of the Guest to Cancel the Contract)

  1. The Guest may cancel or modify the accommodation contract through the Company or the reservation website through which the booking was made.

  2. Cancellation fees (penalties), if any, shall be determined in accordance with the conditions specified for each accommodation plan.

  3. For reservations made through travel agencies or accommodation booking websites, the cancellation policies set forth by such agencies or websites shall apply.


Article 6 (Right of the Company to Cancel the Contract)

  1. The Company may cancel the accommodation contract, even during the accommodation period, in any of the following cases:
    (1) When the Guest violates laws, public order, or these Terms and Conditions.
    (2) When the Guest causes significant disturbance or inconvenience to other guests or neighboring residents.
    (3) When the Guest causes damage to facilities or equipment.

  2. In cases of cancellation under the preceding paragraph, accommodation fees shall not be refunded, except where the Company is found to have acted with willful misconduct or gross negligence.


Article 7 (Guest Registration)

  1. On the day of stay, the Guest shall register their name, address, contact information, and other matters required by laws and regulations in the guest registry using the method designated by the Company.

  2. If the Guest is a foreign national without an address in Japan, the Guest may be required to register their nationality and passport number and present their passport.


Article 8 (Use of Machiya)

  1. The standard hours of use of the Machiya shall be from 4:00 p.m. to 11:00 a.m. on the following day.

  2. Use of the Machiya beyond the prescribed hours shall be subject to additional charges determined by the Company.


Article 9 (Compliance with House Rules)

The Guest shall comply with the Company’s house rules, these Terms and Conditions, and all applicable laws and regulations while using the Machiya and its surrounding areas.


Article 10 (Liability of the Company)

  1. If the Company causes damage to the Guest due to reasons attributable to the Company, the Company shall compensate only for direct and ordinary damages.

  2. Except in cases of willful misconduct or gross negligence on the part of the Company, the Company’s liability shall be limited to JPY 100,000 per accommodation contract.

  3. The Company maintains hotel liability insurance to cover potential accidents such as fire.


Article 11 (Jurisdiction)

Any disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction, in the first instance, of the court having jurisdiction over the location of the Company’s head office.


Article 12 (Supplementary Provision)

These Terms and Conditions shall become effective at the time the accommodation contract is concluded.
